  1. Introduction
    Welcome to Cyfer Plus Sdn Bhd (“we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website  and any related services offered by us (collectively “Services”). By accessing or using our Services, you agree to be bound by these Terms.
  2. Our Services
    We provide the following services:
  • IT Audits & Brand Audit

  • IT administration and support

  • Web development, UI/UX design

  • Social media planning and design

  • Email migration, Office 365 or Google Workspace setup

  • Web hosting and domain sales

  • Content creation and digital marketing

  • Cyber security, training (financial & IT), digital transformation consulting
    and other related IT or digital services as described on our website.

  1. Eligibility
    By using our Services you represent that you are of legal age and have capacity to enter into these Terms, and you will comply with any applicable law.
  2. Accounts & Access
    If you create an account with us, you are responsible for maintaining the confidentiality of your login details, and for all activities that occur under your account. You must notify us immediately of any unauthorized access.
  3. Service Terms, Proposals & Fees
  • Our services are delivered in accordance with proposals approved by you, which set out scope, deliverables, fees, timeline, and terms.

  • Unless otherwise agreed, fees are exclusive of taxes and third-party costs.

  • We may require a deposit or milestone payments.

  • Failure to pay may result in suspension of services.

  1. Client Responsibilities
    You agree to cooperate with us: provide necessary information, access, approvals, materials in a timely manner. Delays may impact delivery and may incur additional costs.
  2. Intellectual Property & Usage Rights
  • We retain ownership of our pre-existing intellectual property (tools, templates, software, methodologies) unless otherwise agreed.

  • Unless otherwise agreed, upon full payment, we grant you a non-exclusive, non-transferable licence to use the deliverables for your internal business use.

  • You warrant that any materials you supply to us do not infringe third-party rights.

  1. Confidentiality
    Each party agrees to keep confidential information of the other party strictly confidential, and to use it only for the purposes of the Services. This obligation survives termination.
  2. Limitation of Liability
  • We endeavour to provide services with reasonable care and skill, but do not guarantee error-free or uninterrupted service.

  • To the maximum extent permitted by law, our liability for any loss or damage (whether direct, indirect, special or consequential) arising under or in connection with these Terms is limited to the total fees paid by you in the 12 months preceding the claim.

  • Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud.

  1. Termination
    Either party may terminate the agreement (or Services) on written notice if the other party materially breaches the Terms and fails to remedy within [e.g., 30] days. On termination you must pay for services performed up to termination and return any confidential information.
  2. Changes to Terms
    We may update these Terms from time to time. We will notify you of any material changes and your continued use of the Services constitutes your acceptance of the updated Terms.
  3. Governing Law & Dispute Resolution
    These Terms are governed by the laws of Malaysia. Any dispute arising out of or related to these Terms shall be subject to the non-exclusive jurisdiction of the courts of Malaysia.
  4. Miscellaneous
  • If any provision of these Terms is found invalid or unenforceable, it shall be severed and the remaining provisions shall continue in full force.

  • These Terms constitute the entire agreement between us regarding the Services.
